Military Accident Claims

We specialise in helping victims of military accidents and injuries claim the army compensation they deserve

Making Military Claims

Everyone who joins the armed forces is aware of the risks of the job. After all, accidents and injuries happen regularly. That said, you have the right to expect that your employer responsibly manages these risks, to minimise the danger of you being harmed.

If you have had an accident or your loved one has been killed while serving in the military, and you believe it was due to negligence, The Compensation Experts may be able to help you claim army injury compensation. We strongly believe that if you put your life on the line, then you need someone to have your back when your employer has let you down; we work with expert personal injury solicitors who understand the process of a successful army compensation claim for a military injury.

What is a Military Compensation Claim?

It doesn’t matter if you have been discharged from your military post or you are still a serving member, you may be able to make a claim for army compensation if you have received an injury as a result of someone else’s negligence. The Ministry of Defence must follow the same Health and Safety at work legislation as any other employer. They also have a duty to take reasonable steps to ensure you are as safe at work as possible.

You may be able to make a claim for military compensation, if you believe your injury was caused by:

  • Insufficient training before carrying out duties in the field.
  • Improper supervision, including training recruits.
  • Inadequate or faulty weapons and equipment.
  • Lack of adequate protective clothing.

Although many roles in the military are inherently dangerous, the MoD should still carry out appropriate risk assessments to ensure every member of staff is protected from reasonably foreseeable danger.

The MoD can claim combat immunity, if the injury happened in conflict with an enemy, but we can advise you on the best course of action if this occurs. However, if your injury was not combat-related, but sustained in another way, perhaps due to having insufficient training, we may be able to help you claim military compensation.

Armed Forces Compensation Scheme (AFCS)

Where a private personal injury claim requires the claimant to prove the other party was at fault, that is not the case with military compensation applications. Armed forces compensation scheme payouts are not dependent on you showing responsibility.

Making a Military Compensation Claim

Claiming compensation from an organisation as large as the MoD may feel daunting, but you do not need to be concerned. The Compensation Experts and your solicitor will be with you every step of the way, guiding you through how to file a military disability claim, keeping you informed, and advocating your rights to ensure you receive fair payment for your injury.

We can help if you were injured in training or on the base, as a result of military bullying, if you have fallen ill due to exposure to a hazardous substance, or if faulty or damaged machinery or equipment has caused you harm.

At The Compensation Experts, we do our utmost to make all military claims as swift and straightforward as possible. Get in touch today to discuss you case, including what determines the class of an army accident and how we can help you claim the No Win, No Fee* military compensation you deserve.
